1. Agreement to Terms
By accessing or using Synthetic (synthetic.actor), operated by Jurij Malovrh ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service.
2. Description of Service
Synthetic is an AI-powered content creation platform that enables users to generate marketing images, manage AI influencer personas, and create branded content using artificial intelligence models. The service includes image generation, character management, preset templates, and related tools.
3. Account Registration
To use Synthetic, you must create an account through our authentication provider (Clerk). You agree to:
- Provide accurate and complete information during registration
- Maintain the security of your account credentials
- Accept responsibility for all activity under your account
- Notify us immediately of any unauthorized use of your account
You must be at least 18 years old to create an account and use the service.
4. Synthetic Credits & Payments
Synthetic uses a credit-based system ("Synthetic Credits" or "SC") to meter usage of AI generation features.
- Free tier: New users receive a one-time welcome bonus of 200 SC.
- Subscriptions: Paid plans (Creator, Pro, Studio) grant monthly credits and additional features. Subscriptions are billed monthly through our payment processor, Polar.
- Credit packs: One-time credit top-ups are available for purchase.
- Credits do not expire and roll over between billing periods.
- Credits are non-refundable once consumed through AI generation. Unused credits on cancelled subscriptions remain available until depleted.
- Pricing may change with 30 days' notice. Existing subscriptions will be honored at their current rate until the next renewal after the notice period.
5. Payment Processing
All payments are processed by Polar (polar.sh), which acts as our Merchant of Record. Polar handles all payment processing, tax collection, and billing. By making a purchase, you also agree to Polar's terms of service. You may manage your subscription, update payment methods, or cancel through the customer portal accessible from your account dashboard.
6. Cancellation & Refunds
- You may cancel your subscription at any time through the customer portal.
- Cancellation takes effect at the end of the current billing period — you retain access to paid features until then.
- After cancellation, your account reverts to the free tier. Remaining credits stay in your account.
- Refunds for subscriptions may be requested within 7 days of purchase if no credits have been consumed. Contact support@synthetic.actor for refund requests.
- Credit pack purchases are non-refundable once credits are consumed.
7. Acceptable Use
You agree NOT to use Synthetic to:
- Generate illegal, harmful, hateful, harassing, defamatory, or obscene content
- Create content that infringes on any third party's intellectual property, privacy, or likeness rights
- Generate deepfakes or misleading content intended to deceive or defraud
- Impersonate real individuals without their explicit consent
- Generate content depicting minors in any inappropriate context
- Circumvent usage limits, abuse the credit system, or exploit the service through automated means (bots, scrapers, etc.)
- Reverse-engineer, decompile, or attempt to extract the source code or AI models
- Resell or redistribute the service's API access without written permission
We reserve the right to suspend or terminate accounts that violate these terms, without refund.
8. AI-Generated Content & Ownership
- Your inputs: You retain ownership of all content you upload (reference images, character descriptions, prompts, etc.).
- Generated output: Subject to the underlying AI providers' terms, you are granted a broad license to use, modify, and commercially exploit images generated through the service for your own purposes.
- No exclusivity: AI models may generate similar outputs for different users given similar inputs. We do not guarantee uniqueness.
- No warranty of accuracy: AI-generated content may contain errors, artifacts, or inconsistencies. You are responsible for reviewing and approving all generated content before use.
- Third-party AI providers: Image generation is powered by third-party AI models (such as Google Gemini). Their terms of service also apply to generated content.
9. Intellectual Property
The Synthetic platform, including its design, code, brand elements, preset templates, and documentation, is the intellectual property of Jurij Malovrh. You may not copy, modify, or redistribute the platform itself. Default character templates provided within the service are licensed for use within Synthetic only.
10. Service Availability & Limitations
- We strive for high availability but do not guarantee uninterrupted service. Maintenance windows, AI provider outages, and rate limits may affect availability.
- Generation quality depends on the underlying AI models and may vary.
- We reserve the right to modify, suspend, or discontinue features with reasonable notice.
- API rate limits and generation quotas are subject to your subscription tier.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYNTHETIC AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
Our total liability for any claim arising from the service is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
12. Indemnification
You agree to indemnify and hold harmless Jurij Malovrh and Synthetic from any claims, damages, or expenses (including legal fees) arising from your use of the service, your content, or your violation of these terms.
13. Termination
We may suspend or terminate your account at our discretion if you violate these terms. You may delete your account at any time by contacting support@synthetic.actor. Upon termination, your right to use the service ceases immediately. We may retain anonymized usage data for analytics purposes.
14. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email or an in-app notification at least 14 days before taking effect. Continued use of the service after changes take effect constitutes acceptance of the new terms.
15. Governing Law
These terms are governed by the laws of the Republic of Slovenia. Any disputes shall be resolved in the courts of Ljubljana, Slovenia.
